Two days ago Abobe announced their plans to "monetize" the Alchemy and Stage3D APIs with the formal release of Flash Player 11.2 and AIR 3.2.

You can read the announcement here:

And a few notable reactions:

So will this mean that once the "speed tax" takes effect (come August 1st according to the article), that any games created with WCK will fall under the 9% licensing fee on revenues over 50K described in the announcement?

From what I understand, "speed tax" will be applied if you use both Alchemy and Stage3d.

Who should use premium features?

The premium features tier is intended to benefit game developers interested in creating the most advanced, graphically sophisticated, next-generation games for the web. The combination of hardware-accelerated Stage3D with domain memory enables the use of compiler technologies like the Adobe Alchemy C/C++ compiler, and advanced C/C++ game engines.

Games and applications using either hardware accelerated Stage3D or domain memory individually do NOT require a premium features license. For example, Flash game developers can independently leverage high-performance Stage3D hardware acceleration in Flash Player – which delivers full GPU-accelerated experiences to more users than any other web technology – at no charge.

If you visit the link I posted above:
Premium features used in games packaged for iOS, Android, and other platforms using Adobe AIR do not require a license.
